There are two paths to claim asylum in the U.S. The affirmative asylum process is for individuals who are not in removal proceedings and the defensive asylum process is for individuals who are in removal proceedings.

Why does USCIS take so long to process asylum cases? USCIS can take many years to process some asylum cases. One of the reasons for this is the way USCIS processes cases. USCIS does not process asylum cases in the order in which they came in, starting with the oldest cases first.

 

Asylum seekers can receive the work permit 180 days after filing their asylum applications.

Wait time: The government must make a decision on asylum seekers’ initial work permit applications within 30 days
If you’ve already received an initial asylum work permit, you can simply apply to renew your work permit before the expiration date. As of May 2022, renewals last for 540 days, or about a year and a half. Before this, renewals only lasted 180 days or half a year.

President Biden’s  administration has added some humanity to U.S. immigration system.

He eliminated the Trump Rule requiring that asylum seekers wait 365 days to apply for work permits.

The new rule allows asylum seekers to apply for work permits 150 days after they receive their asylum receipts.

He has changed the Asylum Processing Rule by allowing Asylum Officers to conduct Asylum Merits Interviews of certain asylum seekers who have passed credible fear interviews rather than having those cases referred directly to the immigration court. If successful, applicants may be granted asylum. 

President Biden has also Terminated former President Trump’s Remain in Mexico Program also know as MPP.

MPP was created by President Trump  to deter asylum by making applicants wait in Mexico while their cases were being adjudicated in US immigration courts.
