K-3 Spouse Visas
The K-3 was designed to shorten the time spouses spend apart while an immigrant petition is pending. In practice it is used far less than it once was, because the underlying petitions are often approved before a K-3 would help.
What a K-3 is
A K-3 is a non-immigrant visa allowing the spouse of a U.S. citizen to enter the United States while their immigrant petition is still being processed, rather than waiting abroad. Once here, they apply to adjust status to permanent residence.
It requires an immigrant petition to have been filed first. The K-3 is a supplement to that process, not a replacement for it.
Why it is rarely used now
This is worth being direct about. When the immigrant petition is approved before or around the same time as the K-3 petition, the K-3 is generally administratively closed and the case simply continues as an immigrant visa. That happens frequently.
The result is that for many couples the K-3 adds paperwork and expense without saving time. It can still make sense in particular circumstances — unusual processing delays, or a pressing need to be together sooner — but it is not the shortcut people often expect.

If a K-3 will not actually help your case, we will say so at the consultation. Filing something that adds cost without benefit does not serve you.
What usually works better
- Straight immigrant petition for the spouse, processed through the consulate, so they enter as a permanent resident.
- Adjustment of status where the spouse is already lawfully in the United States.
- K-1 fiancé visa where you have not yet married and want to marry in the U.S.

It continues. If it is approved first, the K-3 is generally closed and the case proceeds as an immigrant visa, which is usually the better outcome anyway.
Do children come too?
Unmarried children under 21 can generally accompany a K-3 parent on a related visa category.
