TN Status for Canadian and Mexican Professionals
The TN category lets citizens of Canada and Mexico work in the United States in specific professions set out by treaty. There is no annual cap and no lottery, and for Canadians it can often be obtained quickly. The catch is that the profession list is closed and the job has to fit it precisely.
What TN status is
TN is a nonimmigrant category created by the North American trade agreement and continued under the USMCA. It allows citizens of Canada and Mexico to work in the United States in a defined list of professions, for a U.S. employer or in some cases a foreign employer with a U.S. contract.
It has real advantages over other work categories. There is no annual cap, so there is no lottery and no waiting for a filing window. It is granted in increments of up to three years and can be renewed indefinitely, provided the underlying facts still hold.
TN is temporary by design
TN carries an intent requirement: you are asserting that your stay is temporary. That does not make it impossible to pursue permanent residence later, but doing so carelessly — particularly around renewal or re-entry — can cause a refusal. If a green card is the goal, plan the sequence with an attorney rather than improvising.
Who can use it
Citizenship
You must be a citizen of Canada or Mexico. Permanent residents of those countries do not qualify.
A listed profession
The role must appear on the treaty profession list. If it does not appear, there is no TN available however senior or skilled the position.
The stated credentials
Each profession specifies its own requirement — usually a bachelor’s degree, sometimes a licence or a defined combination of diploma and experience.
A prearranged position
You need a U.S. employer or a signed contract. TN does not permit you to arrive and look for work, and it does not cover self-employment.
Work at a professional level
The duties must actually be the professional work described. A qualifying job title over largely non-professional duties will not hold up.
Temporary intent
You must intend a temporary stay, even though renewals are permitted and many people hold TN status for years.
The profession list
TN is unusual in that it works from a closed list. The treaty names roughly sixty professions and states the credential each one requires. Some of the most frequently used include:
- Accountant, Economist, Management Consultant
- Computer Systems Analyst, Engineer, Mathematician (including Statistician)
- Scientific Technician or Technologist, working in support of a professional
- Architect, Land Surveyor, Urban Planner, Industrial Designer
- Pharmacist, Physician (teaching or research only), Registered Nurse, Physiotherapist, Dietitian, Medical Laboratory Technologist
- Lawyer, Librarian, Social Worker, Teacher at college or university level
Two roles cause more trouble than any others. Computer Systems Analyst is on the list, but many modern software jobs are treated as programming rather than systems analysis, and programming is not on the list. Management Consultant is on the list, but it is meant for genuine outside consultants providing services under contract, not for someone taking an ordinary management job.
The job description does the work
Because the list is closed, TN cases are won or lost on how the offer letter is written. It has to name the profession, describe duties that genuinely match it, state the credential you hold, and set out the temporary period and the arrangements for payment. A vague or over-broad letter invites a refusal.

Whichever route applies, you should carry proof of citizenship, the employer’s support letter, your degree and credential evaluation where relevant, and any licence the profession requires.
Where TN cases go wrong
Applying at the border is fast, but it also means an officer decides on the spot, with limited scope to argue afterwards. The recurring problems are worth knowing in advance.
- The role does not match the listed profession. Most commonly a software role presented as Computer Systems Analyst, or an in-house manager presented as Management Consultant.
- The credential does not match. Each profession has its own requirement, and a degree in a loosely related field is not automatically enough.
- The support letter is too thin or too broad. Letters that list every possible duty tend to read as though the role is not really the named profession.
- Immigrant intent. A pending green card process, or answers suggesting a permanent move, can defeat the temporary intent requirement.
- Self-employment. TN does not cover working for your own company, and thinly disguised arrangements are refused.
A refusal at the border follows you
There is generally no appeal from a refusal of admission, and the record of it will surface at every future application. If there is any doubt about the fit, it is far better to resolve it beforehand — or to have the employer file with USCIS, where a denial can be reviewed — than to find out at the port of entry.
Spouses and children
Spouses and unmarried children under 21 can accompany you in TD status for the same period. TD holders may study but are not authorised to work. Families who need two incomes should plan for that early, since the working spouse will usually need a status of their own.

Frequently asked questions
How long does TN status last?
Up to three years at a time, and it can be renewed indefinitely so long as the role, the credential and the temporary intent still hold. Renewals are not automatic and each one is a fresh assessment.
Can I apply for a green card while on TN?
You can, but TN is not a dual-intent category, so the sequence matters. Starting a permanent residence process can complicate renewals and re-entry. Many people move to a dual-intent status such as H-1B or L-1 first. Get advice before filing anything.
Can I work for more than one employer?
Yes, but each employer needs its own TN authorisation. You cannot simply add work on the side under an existing TN.
My job title is not on the list. Is there any way around it?
Not by relabelling the job. What sometimes works is recognising that the actual duties fit a listed profession properly, and describing them accurately. If they genuinely do not, the answer is another category — often the H-1B.
Was TN affected by the USMCA?
The TN category continued substantially unchanged when the USMCA replaced NAFTA. The profession list and the credential requirements carried over.
What if I am refused at the border?
Speak to an attorney before trying again. A second attempt with the same paperwork usually produces the same result. Depending on what went wrong, the better route may be a corrected support letter or an employer-filed petition with USCIS.
